Have your photos or videos been published without permission?

The Australian Copyright Act contains certain exceptions to copyright infringement for the ‘fair dealing’ of copyrighted material for specified purposes.

The Australian Copyright Act allows copyright material to be used without permission following purposes:

  • Research or study
  • Criticism or review
  • Parody or satire
  • Reporting news
  • Professional advice by a lawyer, patent attorney or trade mark attorney
  • Enabling a person with a disability to access the material

Copyright material may be used in reporting news in a newspaper, magazine (or similar periodical, such as online) or film, or by means of a broadcast, provided that the use is “fair”.

The author and title of the work must be acknowledged, and ‘news’ is not restricted to current events.

Our editors and producers may add Pulse branding to ensure consistency across all content on our platforms, and we may also cover up captions or other text for viewer clarity.

Has a photo of yourself or someone you know been published without consent?

By law in Australia, taking photos of people and places in a public area (eg, not through the window of somebody’s home) does not require permission for the purpose of news publication.

Photographers, generally speaking, can freely photograph everyday situations, people and places, as long as they aren’t breaking any other laws (such as trespassing).

Our staff photographers aim to obtain permission where possible, however asking subjects for permission before taking their photo for the sake of public interest (such as covering important newsworthy events and issues) can hinder our journalistic integrity and authenticity.

Media contribution terms and conditions

By contributing your content to any Pulse Media Group Pty Ltd service or platform, you grant Pulse Media Group Pty Ltd, its subsidiaries, affiliates and distribution partners a royalty-free, non-exclusive licence to use your content in any media worldwide.

By agreeing to let us use your content, you hereby acknowledge that you are the owner of this content and grant us permission and license to use your content in perpetuity on our all digital, broadcast, print and other platforms, owned, operated or which are provided services to by Pulse Media Group Pty Ltd.

From time to time, your content may also be used for brand promotional purposes. Your content might also be altered in respect of colour, size and other properties.

You confirm you own or have the right to use any copyright material included in your content (including music, photos, quotes and excerpts of audio or video), that you have permission of anyone appearing or performing in your content and that you are not infringing any person’s rights by submitting the content to Pulse Media Group Pty Ltd.

You also confirm you have, where appropriate, sought the consent of the parent or guardian of any person under the age of 18 who is featured in your content.

Pulse Media Group Pty Ltd will endeavour to provide you with an appropriate credit when using your content on Pulse Media Group Pty Ltd platforms, though you understand and agree this may not always be possible.

Implied credit may be inferred in scenarios where the source of the content is obvious or directly linked to the story, making explicit attribution redundant and unnecessary.

This permission and license is granted notwithstanding any other licensing or content agreement you have with any other party either now or in the future.
